Terms and Conditions

1. Who is eligible?

By using DonkeyBid.com's services, you acknowledge your acceptance of these terms and conditions and confirm that you are 18 years of age or older, and that you are willing and capable of entering into a binding agreement.

2. General Terms

By accepting these terms, you acknowledge that you are licensed and bonded, and hold all necessary permits or certifications that your line of work may require. Furthermore, you agree that all subcontractors you hire for projects resulting from DonkeyBid.com referrals shall also possess the mandatory qualifications as outlined by Federal Law and the State of Texas. You agree that all projects resulting from DonkeyBid.com referrals will be conducted in a professional manner, and you understand that failure to abide by these requirements may results in cancellation of this agreement at the sole discretion of DonkeyBid.com.

All terms mentioned in this agreement are subject to change at any time by DonkeyBid.com. The ability to amend contractor agreements includes, but is not limited to, the DonkeyBid.com pricing structure. In addition, DonkeyBid.com reserves the right to cancel this agreement at any time.

Through use of DonkeyBid.com services, you agree that DonkeyBid.com is authorized to contact site members via supplied telephone and fax numbers, or email addresses.

Member authorizes DonkeyBid.com and affiliates to conduct a background check by viewing credit report, contacting licensing agencies, or other such seasonable background checks as permitted by law.

By using the services offered at DonkeyBid.com, you are aware that DonkeyBid.com is not acting as your advisor, or agent. It is your individual responsibility to negotiate all terms for any work that is performed. Any related expert advice, including insurance and legal, you wish to seek regarding contracts, permits, etc. is solely at your discretion and is your own responsibility. Furthermore, DonkeyBid.com does not endorse any particular service professional, screen his or her personal credit or legal standing, or recommend the use of services a contractor might offer.

DonkeyBid.com does not guarantee that we will be able to match your skills or services with any incoming requests for quotations. Although we take various measures to ensure we accurately screen homeowners' requests, it is ultimately up to you to accept bid offers, negotiate with, enter into agreement, or dispute the request submitter. Your contractual rights are typically governed by local and state laws. Should a situation arise in which you dispute any customer-related project or request, you must only address the dispute to the customer directly. You unconditionally agree to release DonkeyBid.com, its employees, business partners, and agents from any and all damages or claims. This includes connected disclosed, undisclosed, consequential, incidental, know, and unknown damages and claims that may arise on or after your dealings with homeowners or other customers.

The licensing and insuring of service professionals and contractors is not guaranteed by DonkeyBid.com and it is your sole responsibility to ensure the accuracy of the information provided at the time you enter into an agreement with a DonkeyBid.com user. It is your responsibility to maintain current proof of insurance or licensing, and to notify DonkeyBid.com if the validity period of your license expires, or if any changes in required documents occur.

The data and references DonkeyBid.com collects from third parties and service providers is often in electronic form. This method of data collection enables us to screen the contractors we choose to include in our database; however, various factors (i.e. pending actions, time delays, human error, etc.) contributing to the accuracy of this data remain out of our control. DonkeyBid.com will not be held liable for incidentals in any way related to the reporting of inaccurate data by third parties or service professionals.

3. Disclaimer of Warranties

DonkeyBid.com and its partners, employees, or associates disclaim all warranties of any kind, whether express, implied, or statutory, regarding the service of contractors, the authenticity of customer requests, or other Third Party sources or information. DonkeyBid.com does not warranty the validity of projects requested by site users, or guarantee that projects can be completed in a timely or continuous manner. DonkeyBid.com will not be held responsible for any information obtained from homeowners or other Third Party sources. Member agrees to defend, indemnify and hold DonkeyBid.com harmless from liability of any kind arising out of services performed by member, including, without limitation, claims by any customer, subcontractor or supplier. Information obtained through DonkeyBid.com must be used at your own discretion and risk; however, these exclusions are only valid as permitted under state law and other jurisdiction.

4. Account Usage

By using your DonkeyBid.com account or allowing others to use your account, you agree to comply with all applicable state or federal laws and regulations. You understand that our service should not, in any way, be used to impersonate any person or persons nor be used as a harassment device. DonkeyBid.com will not assume responsibility for the inappropriate usage of any accounts, and may choose to terminate user accounts, at our sole discretion, if this type of usage should occur. You are not permitted to reproduce, distribute, transmit, publish, or commercially exploit information obtained through the use of DonkeyBid.com without our express consent.

5. Billing

Referral fees and other membership related costs are payable upon acceptance by the member contractor or service provider. Member agrees to pay cost required by DonkeyBid.com regardless of contact by the service requester, or success of project bidding.

Member authorizes DonkeyBid.com to charge the supplied credit card for selected membership package and for future bids immediately or per designated billing cycle, when accepted by member service providers.

Member understands that DonkeyBid.com will automatically charge the provided account the yearly, agreed upon membership fee, as selected by the member. This fee includes all services charges and screening fees associated with member accounts.

Should member account contain insufficient funds at time of billing, a $30.00 fee will automatically be applied to account. If delinquent account is referred to collection agency, member shall incur all collection related costs.
